Serious allegations have been raised regarding the purchase and sale, possession, unauthorized construction of a building, inconsistency in documents and security of the building of a flat in West Paikpara of Brahmanbaria city. A tense situation has arisen centering on the dispute between both parties in this regard. In this incident, concerned people are fearing deterioration of law and order situation and conflict at any time. Regarding the issue, a case has been filed in the court of the learned Additional District Magistrate of Brahmanbaria on 30/8/2026 under sections 144 and 145 of the Code of Criminal Procedure.
According to the information of the petition filed in the court, Md. Asifur Rahman, a resident of West Medda area of Brahmanbaria Sadar Upazila, has filed the said case himself as the plaintiff. In the petition, four people including Moinul Islam Adnan and others have been made the second party.
The application states that an agreement was made to purchase the concerned flat and land from the second party for a total of 60 lakh taka. For the purpose of availing bank loan facility in this regard, 70 lakh taka was mentioned in the deed of agreement. The plaintiff of the case claims that 15 lakh taka in cash on March 9, 2026 and another 10 lakh taka through the bank have been paid. After that, he has been in possession of the concerned flat and land and has spent about 30 lakh taka for about 2 long months on various works and beautification there. It is alleged that the second party constructed a new flat on the 8th floor of the building without the approval of the municipal authorities. When objected to the matter, although it was said that there was approval, the plaintiff came to know that there was no approval for such extended construction after contacting the concerned municipal authorities. Concern has arisen about the structural safety of the building due to additional construction on the roof. After contacting several civil engineers and reviewing the structure of the building, they have expressed fear of risk, the applicant has claimed. It is also mentioned in the application that panic has been created among the residents of the building and surrounding people.
Apart from this, the building was not constructed according to the approved design. Extensive errors have been found while preparing the documents of the flat and land for registration. At the same time, although the area of the flat was mentioned as 1,300 square feet in the deed of agreement, it was found to be 1,182 square feet in field measurement, as mentioned in the application. When asked to the second party about these issues, they did not give a proper explanation and threatened to evict the applicant from the flat, as alleged in the petition filed in the court. The plaintiff has mentioned to the court that there is a fear of clash, riot or deterioration of law and order situation between both parties in this incident.
In this situation, the plaintiff has applied to the court to give necessary orders according to the provisions of sections 144 and 145 of the Code of Criminal Procedure to restrain the second party from forcibly evicting him from the flat in his possession, trespassing or creating any kind of obstruction to his and his family's peaceful possession. Accordingly, after analyzing the plaintiff's petition and other documents, the court directed the OC Sadar to maintain peace and order. However, the statement of the second party regarding the complaints filed in the court could not be known immediately. The matter is currently under consideration of the court.
